In this action for a motor vehicle negligence, the plaintiffs alleged that the defendant’s failure to yield the right of way at an intersection, proximately caused the plaintiffs’ injuries. The defense denied all allegations of negligence.
On March 13, ________, the plaintiffs were traveling eastbound on Orangethorpe Avenue in Fullerton. Suddenly, they were struck by the defendant’s vehicle as the defendant attempted to negotiate a left hand turn. The plaintiffs’ vehicle then struck the base of a traffic signal; trapping the plaintiffs inside the vehicle for 30 minutes until they could be extricated by the Fullerton Fire Department.
As a result of the collision, each of the three individuals in the plaintiffs’ vehicle suffered various injuries. Two of the plaintiffs suffered from multiple rib fractures, one of whom also suffered an open right ankle fracture. The third plaintiff suffered multiple injuries associated with blunt force trauma, and passed away eight hours later at the UCI Medical Center. Each of the two surviving plaintiffs was hospitalized. The plaintiff that suffered the ankle fracture was hospitalized for six days, underwent ankle surgery, and then endured ten weeks of not being able to bear weight on her foot, which was followed by intense physical therapy. Additionally, the plaintiff suffers from early arthritic changes in the ankle, and will likely need to have surgical hardware removed from the ankle in the future.
The surviving plaintiffs sued the defendant for negligence. Overall, they argued that the defendant failed to yield the right of way at an intersection. In support of their argument, the plaintiffs pointed out that the defendant was cited for violation of Vehicle Code Section ________(a), failure to yield the right of way.This matter ultimately resolved following a session of mediation. The surviving plaintiffs recovered the total sum of $________. A separate action has been filed by the legal heirs of the deceased.
