The plaintiff pick-up truck driver, 46 at the time, contended that he was struck in the rear as he was turning right and that the vehicle overturned as a result of the impact. The plaintiff maintained that he suffered two cervical and two lumbar herniations that were confirmed by MRI. The plaintiff’s treatment consisted of five months with an orthopedist, five months with a neurologist and three months of physical therapy.

The plaintiff contended that he will suffer permanent pain and limitations, and that the appearance of the plaintiff palpably reflected an individual who was in great pain. The plaintiff further maintained that he suffered a concussion and post-concussion syndrome and lost consciousness for a brief period. The plaintiff contended that he will suffer headaches permanently.

The plaintiff had been employed as a service manager for a termite company. He returned to light duty three months later and contended that he was subsequently discharged because he could not adequately perform his duties. The plaintiff has been unable to obtain work.

The defendant denied that the plaintiff was unemployable. The plaintiff countered that in view of the physical difficulties and economic picture, obtaining a job will clearly be very difficult. The plaintiff further maintained that the restrictions have caused a very significant emotional reaction which the plaintiff’s examining psychiatrist contended is permanent in nature.The case settled prior to trial for $________.
