Fraud – Plaintiff contends his name on deed conveying partial title of real estate to then-girlfriend is forged – Bench trial.

The plaintiff in this fraud action contended that a conveyance in which partial title to real estate was conveyed to his former girlfriend was invalid and that his signature was forged by the defendant, an attorney. The plaintiff maintained that he had never been to the law office at which he allegedly signed the document. The defendant maintained that the plaintiff had validly executed the documents.

The defendant pointed out that the plaintiff did not present a handwriting expert. The defendant also elicited testimony from the plaintiff during cross examination, that while he may have been mistaken as to whether he had been to the law office in the past, he was not aware of the contents of any documents that he might have signed.The court found for the defendant.
