This medical malpractice action involved the death of the 26-year-old female decedent following what the plaintiff claimed was a routine asthma attack. The plaintiff alleged that the paramedics employed by the defendant county negligently intubated into the plaintiff’s esophagus instead of her trachea, thereby causing her ultimate death.

The plaintiff alleged that the decedent suffered a routine asthma attack and ________ was called. The defendant’s paramedics arrived and, according to the plaintiff’s claims, negligently intubated the decedent into her esophagus instead of her trachea. The plaintiff claimed that the negligent intubation caused the decedent to suffer cardiac and respiratory arrest, seizures, coma, brain death upon arrival at the emergency room and her ultimate death three days later when she was removed from life support systems.

The plaintiff contended that X-rays taken in the emergency room showed that the decedent’s intubation was in the esophagus and stomach instead of the trachea. The hospital’s emergency room trauma physician also confirmed the improper intubation by the emergency medical service team, according to the plaintiff’s claims. The plaintiff additionally alleged that the defendant’s emergency medical personnel were not properly trained, that the medical equipment on board the ambulance did not function properly, was not adequately inspected and maintained by the defendant and that paramedics failed to follow protocol procedures set forth in the defendant county’s EMS manual.

The decedent was survived by her husband and three children, ages three, five and six at the time of her death. She was employed as a medical assistant.The case was settled pre-suit for the applicable $________ governmental liability cap. The settlement agreement requires that the identification of the parties remain confidential.
