The plaintiff, in her 40s, who was walking home from her friend’s home, contended that the contractor pouring concrete on the walkway of her apartment complex negligently failed to either clear or barricade the area after completing the work for the day and before the project was finished. The plaintiff contended that as a result, she slipped and fell on loose gravel in the construction site. The defendant maintained that the cause of the incident was the negligent failure of the plaintiff to walk more carefully and make better observations.

The plaintiff contended that she sustained facial lacerations and will permanently be left with noticeable scarring in the upper lip area despite laser treatments and a surgical revision that are contemplated in the relatively near future. The plaintiff also contended that she trigger finger on the right fourth finger and will require a surgical release of the A-1 pulley in the foreseeable future. The plaintiff made no income claims.
