This was an action brought by the female plaintiff, in her mid- 50’s, for injuries suffered when she was struck on the head by a falling camera while attending a hockey game sponsored by the defendant Springfield Indians Hockey Club. The plaintiff claimed that she sustained soft tissue injuries to her neck and back and developed a chronic headache disorder as a result of the blow to the head.

The evidence indicated that the plaintiff was sitting under the press box during a Springfield Hockey Club game when a camera fell from the press box and landed on her head. The plaintiff contended that the defendant was liable for allowing the camera to be precariously placed on the edge of a table in the press box above the area where patrons were seated.

The plaintiff’s treating physician testified that the plaintiff suffered soft tissue injuries to her neck and back attributable to the incident.

The defendant denied responsibility for the placement of the camera. The defendant disputed that the plaintiff’s headaches were caused by the subject incident. The defendant additionally maintained that the plaintiff overtreated.
