$________ Landlord’s Negligence – Failure of landlord to supply radiator covers or have shut-off valve on radiator – Plaintiff guest of tenant has seizure and falls on radiator – 2nd and 3rd degree burn injuries to upper arm and chest.

The plaintiff, a guest of a tenant who resided in an apartment in the defendant’s building, contended that the defendant landlord failed to supply radiator covers and that the radiator was dangerous because it did not contain a working shut-off valve. The plaintiff asserted that when he suffered an epileptic seizure and collapsed, he fell onto the radiator and suffered severe burns.

The defendant argued out that there were no code violations. The plaintiff maintained that the Multiple Dwelling Act did require the radiator to be covered and to be operating safely. The plaintiff’s engineer would have maintained that the radiator was clearly dangerous.

The plaintiff contended that he suffered 2nd and 3rd degree burns to left upper arm, left wrist, left back and left upper chest. The plaintiff’s burn specialist would have related that the plaintiff required the surgical excision and preparation of burn wound beds for skin grafting and a skin graft procedure. The physician would have maintained that the plaintiff will suffer permanent restriction of use and scarring. The plaintiff made no income claims.The case settled prior to trial for $________.
