The male plaintiff motorcycle operator, age in his early 20s, contended that the defendant driver negligently failed to yield before making a left turn into his path. The defendant contended that he had already begun his turn when the plaintiff failed to obey the red light, causing the collision.

The plaintiff called an independent witness who testified that the defendant failed to yield the right-of-way to the plaintiff’s motorcycle. He contended that he suffered a tear of the medial meniscus. He maintained that he required arthroscopic knee surgery and that despite the surgery, he will suffer permanent pain and some difficulties ambulating. The defendant denied that the plaintiff suffered the claimed injury or that surgery was necessary.

The plaintiff was able to return to work as a plumber. The defendant offered $20,000 at trial. The jury found the defendant 100% negligent and the plaintiff was awarded $465,000. The defendant had $300,000 in coverage, which was paid.
