The 73-year-old plaintiff, Judith W., was diagnosed with mesothelioma in January ________ after using Cashmere Bouquet manufactured by Colgate-Palmolive Company of New York, New York. Mesothelioma is a rare cancer linked to asbestos exposure, including the asbestos-containing talc in the defendant’s product.

Mrs. W and her husband filed suit in Los Angeles Superior Court, naming as defendant the Colgate-Palmolive Company. The plaintiffs filed several counts, including failure to warn and negligence, and sought both compensatory and punitive damages. The defendant denied the accusations.

Among the evidence presented at trial was that Colgate-Palmolive knew or should have known about the dangers of asbestos since the ________’s. This is the first verdict against Colgate-Palmolive involving asbestos exposure from talcum powder.The jury unanimously found the defendant 95 % liable on five counts: Consumer expectations, risk-benefit, manufacturing defect, failure to warn, and negligence. The jury also found that Colgate-Palmolive acted with malice. The jury awarded $________ in damages. The matter was resolved post-verdict with a confidential settlement before the trial’s punitive damages phase was set to begin.
