In this negligence matter, the plaintiff patient alleged that the defendant hospital’s staff failed to properly supervise and montir the plaintiff after sedating him and placing him in a stretcher without railings lifted. As a result, the plaintiff fell from the stretcher and injured himself. He was diagnosed with injuries, including: A fractured hand, cervical strain, and ligament damage. The defendant denied the allegations of negligence and disputed the plaintiff’s claims of injuries and damages.The male plaintiff was a patient at the defendant’s hospital on the date of this incident. The plaintiff was placed in a stretcher bed and given a 50mg dose of Benadryl to sedate him. The plaintiff alleged that the hospital staff failed to raise the railings on the side of the bed and failed to monitor him in his sedated state. As a result, the plaintiff fell from the bed and was injured. The plaintiff suffered injuries including: A fractured hand, ligament damage, carpal tunnel syndrome, and cervical spine strain as well as suffering emotional distress over the incident. The plaintiff brought suit against the defendant alleging negligence in its care and supervision of the plaintiff.

The defendant denied the allegations, and maintained that its staff was not negligent in its care and supervision of the plaintiff. The defendant maintained that the plaintiff’s bed had the railings raised and that the plaintiff’s injuries were likely self induced since he had been admitted on a suicide watch and was agitated. The defendant further argued that the injuries to the plaintiff’s hand most likely occurred prior to the fall and could have been as a result of an infection or heroin injections by the plaintiff.The matter proceeded to a bench trial. At the conclusion of the trial, the court found in favor of the plaintiff and against the defendant. The court awarded the plaintiff the sum of $________ in damages consisting of $________ in economic damages and $________ in non-economic damages.
