$________ COMBINED – INVASION OF PRIVACY IN THE WORKPLACE – SEXUAL HARRASSMENT – INSTALLATION OF VIDEO CAMERA IN LADIES BATHROOM – EMOTIONAL INJURIES TO TWO PLAINTIFFS.

Broward County, FL

The two female plaintiffs brought this action against the company they previously worked for, as well as its owner of the company, alleging emotional injuries caused by the installation of video cameras in the ladies bathroom at work and other sexual harassments. The plaintiffs asserted claims of invasion of privacy and defamation. The defendant company owner died prior to trial, and the case was continued against his estate. The defendants did not dispute liability, but contested the damages which the plaintiffs claimed resulted from the existence of the video camera, as well as the sexual harassment.

The defendant was a small company, with four to five employees, which sold after-market auto parts. The two female plaintiffs, who were employees of the defendant, testified that they received a call at work from an informant, who told them to go look in the ceiling of the ladies room.

The plaintiffs looked where they were directed and discovered a video camera in the ceiling of the ladies restroom. The camera was hooked up to the defendant owner’s office computer. The plaintiffs called the sheriff after discovering the camera.

The camera was found, and the defendant owner was arrested and criminally prosecuted for his actions.

The plaintiffs also asserted a count against the defendant owner for defamation, alleging that he publicly accused them of lying about the existence of the video camera. One plaintiff asserted a claim for loss of wages.

The defense maintained that the plaintiffs had mostly recovered from the emotional distress caused by learning of the video camera. The jury found for the plaintiffs in the combined amount of $________. The first plaintiff was awarded $________ and the second plaintiff received $________.
