The 55-year-old male plaintiff mechanic working at a potato chip facility contended that the defendant’s industrial tool was defective because of the absence of any literature or other warnings regarding a sharp knife which was covered in a plastic sheath. The plaintiff claimed that the tool resembled a hex wrench, that he had no idea that a knife was located under the plastic sheath and maintained that he believed that the plastic was a wrench handle. The plaintiff contended that as he began using the tool, which he believed was a wrench, he suddenly suffered a severe laceration to the middle and index fingers on his dominant hand. The tool was supplied by the defendant American distributor of the Taiwanese manufacturer, against whom service could not be effectuated.

The plaintiff required surgery and contended that he will permanently suffer some pain and weakness in the fingers. The plaintiff was able to return to work and made no income claims.

The plaintiff contended, however, that he had formerly been an avid body builder and has been forced to greatly restrict this activity.
