This case involved a plaintiff union carpenter, in his 40s, who was using the defendant’s drywall stilts to apply wall angling on the ceiling of a room. The plaintiff asserted that the stilts deviated from specifications resulting in the stilts snapping and the plaintiff injuring his leg on the stilt as he fell.

The stilts were manufactured overseas. The plaintiff maintained that the defendant knew its stilts were not manufactured to specification prior to selling them. The evidence disclosed that as the plaintiff was using the stilts in order to avoid having to use a ladder or scaffold as he was applying drywall to the upper portion of the room, one of the stilts snapped and that he injured his leg and knee, sustaining an ACL tear.

The plaintiff underwent reconstructive surgery. The plaintiff contended that because of continued arthritis causing severe pain and difficulties, he underwent knee replacement surgery and revision surgery. The plaintiff claimed that he will permanently suffer pain and difficulties ambulating. The plaintiff maintained that he will probably require additional knee replacements over the course of his life expectancy, as well as future therapies and physician visits.

The plaintiff would have also contended that he is permanently precluded from working as a carpenter or other physically rigorous work.
