In this negligence matter, the plaintiff alleged that the defendant supermarket was negligent in allowing a hazardous condition to exist in the form of a curled floor mat at the store’s entrance. As a result of the defendant’s negligence, the plaintiff tripped and fell, suffering a cervical fracture that rendered her an incomplete quadriplegic. The defendant denied the allegations and disputed the nature and extent of the plaintiff’s injuries and damages.

On March 22, ________, the 57-year-old female plaintiff, a grade school teacher, was entering the defendant’s store. While entering the north vestibule of the store, the plaintiff tripped and fell on a curled mat. As a result of the fall, the plaintiff suffered a C6 fracture which caused incomplete quadriplegia. The plaintiff had testimony from two post-occurrence witnesses who saw the edge of the mat in a curled and rigid position. The plaintiff alleged medical expenses of $________ and lost income of $________. The plaintiff brought suit against the defendant store alleging negligence. The plaintiff contended that the defendant’s active conduct in placing an already curled up mat inside the vestibule, when it, in fact, should have been taken out of service, was negligent. The plaintiff’s husband brought a claim for loss of consortium.

The defendant denied liability and disputed the nature and extent of the plaintiff’s injuries and damages. The defendant maintained that the plaintiff’s fall was solely as a result of the plaintiff’s own negligence and denied that the mat was curled. The parties agreed to resolve the plaintiff’s claim for the sum of $________ in a settlement prior to the trial in this matter.
