U.S. District Court, Eastern, California

In this sexual harassment matter, the plaintiff employees, who were farmworkers, alleged that they were sexually harassed while on the job. The plaintiffs alleged that they were retaliated against when they complained about the treatment, and were not re-hired. The defendant denied any wrongdoing and disputed the allegations.

The plaintiff employees are female Latin farmworkers who work for the defendant – one of the largest processors of dried fruits in the country. The plaintiff employees opined that they were continually subjected to sexual harassment in the form of sexual comments, leering, hugging, kissing, requests by coworker for dates or sex, and physically touched. When the plaintiffs complained to the defendant, nothing was done. The plaintiffs complained to the EEOC – who brought an action on the plaintiffs’ behalf – alleging sexual harassment, and maintaining that they were not hired in retaliation for their complaints. The defendant denied the allegations and denied any wrongdoing. The parties agreed to enter into a consent agreement where the defendant would pay the injured workers a total of $________ in monetary compensation, and would implement training if the company – which is no longer in business – were to reopen.
