This product liability suit is the most recent verdict involving ongoing ACTOS litigation against a Japan-based pharmaceutical company. The suit was heard and resolved in the Philadelphia Court of Common Pleas.

The plaintiff, a retired 74-year-old teacher from Slippery Rock, Pennsylvania, was prescribed Actos (pioglitazone) to manage his diabetes. Actos is produced by the defendant, Takeda Pharmaceuticals America Inc., a subsidiary of Takeda Pharmaceutical Company Ltd. In ________, the plaintiff later developed bladder cancer, a purported side-effect of Actos, and has since underwent the surgical removal of his bladder.

The plaintiff filed suit in the Philadelphia Court of Common Pleas for product liability, accusing Takeda of failing to warn him of the dangers associated with their product. The plaintiff sought damages for medical expenses, as well as pain and suffering. The defendant denied the accusation.The jury found for the plaintiff, concluding that defendant was a significant cause of the plaintiff’s bladder cancer, and that his physician was not appropriately warned about the drug’s risks. The jury awarded plaintiff $________ in compensatory damages. The jury also found defendant’s conduct was "Outrageous due to an evil motive or conscious indifference, recklessness, wanton disregard for the health, safety, and rights of plaintiff’s,” and awarded $________ in punitive damages.
