Medical Malpractice – Hospital negligence – Alleged contraindicated administration of anticoagulation drug following kidney biopsy – Death action.

This was a medical malpractice action involving a 60-year-old patient who died during a hospital admission in light of end stage kidney disease. The plaintiff is the decedent’s son and sole survivor under the Wrongful Death Act, claimed that his mother died as a result of a myocardial infarction caused by demand ischemia following a perinephric bleed exacerbated by the administration of Lovenox. The defendants contended that the patient’s death was the result of myocardial arrest attributable to unstable coronary artery plaque.

The plaintiff contended that the defendant hospitalist improperly ordered Lovenox after a renal biopsy, contingent upon approval from interventional radiology, which performed the biopsy. Lovenox was given contrary to the terms of the hospitalist’s order. Discovery revealed that the hospital pharmacist failed to accurately transcribe the medication order, and that the nurses did not identify the pharmacy error. The defendants obtained a directed verdict on Fabre negligence as to the non-party hospital, but the jury returned a complete defense verdict.The jury found that the defendant physician was not negligent.
