$________ – FEDERAL TRADE COMMISSION ACT VIOLATION – FOR-PROFIT COLLEGE ACCUSED OF MISREPRESENTING PROGRAMS.

U.S. District Court, Northern, Georgia

In this action, the Federal Trade Commission (FTC) accused a for-profit education institution of misrepresenting to its students the training and credentials they would need for their education. The matter was resolved with a settlement.

The defendant, Professional Career Development Institute, LLC (which does business as Ashworth College) is a for-profit college based in Peachtree Corners, Georgia. The FTC alleged that degrees and programs offered by Ashworth College failed to meet the basic educational requirements set by state licensing boards for careers or jobs, including real estate appraisers, home inspectors, elementary school educators, and massage practitioners. The FTC further alleged that defendant claimed that its credits would transfer without data to support these claims.

In May ________, the FTC filed a complaint in the U.S. District Court for the Northern District of Georgia, accusing defendant of violating the Federal Trade Commission Act (FTC Act) through deceptive marketing of its online college degree and career-training programs. The FTC’s complaint was resolved with a settlement for $________. The defendant was also forbidden from representing its program as qualifying students to obtain vocational licenses without any additional training or experience – from representing its programs as providing all training and credentials required to switch careers or obtain a job in a new field – to representing its course credits in its programs as being generally recognized and accepted by other post-secondary institutions, and from representing that there will be job security or steady employment for consumers completing its programs.
