The defendant, Lawrence, is a city in Essex County, Massachusetts. This action arose from accusations by the U.S. Environmental Protection Agency (EPA) that defendant failed to comply with the Clean Water Act (CWA) with respect to the operation of its publicly-owned treatment works, which it uses to collect and treat sanitary sewage and industrial wastes, and in the operation of its municipal storm water collection system.

The United States, on behalf of the EPA, filed suit in the U.S. District Court for the District of Massachusetts, accusing the defendant, City of Lawrence, of violating the CWA, as well as applicable regulations relating to the City’s National Pollution Discharge System permit and small municipal separate storm sewer system permits. The plaintiff sought compliance measures by the defendant to correct the alleged breach.The matter was resolved via settlement, in which the defendant agreed to undertake various measures to study and correct the problems, causing the alleged permit violations in order to achieve compliance with the CWA and applicable regulations.
