The plaintiff, in this case, contended that the defendant resort negligently failed to provide a sufficiently slip resistant floor on the steps of an attraction on the Liberty Belle paddle wheel steamship attraction at the Magic Kingdom.

The plaintiff maintained that she suffered a lumbar disc herniation that will cause permanent symptoms and require surgery.

The defendant supported that the attraction was safe, and that the negligence of the plaintiff – who was wearing flip-flops – contributed to the incident.

The defendant also maintained that the jury should consider that that, although the plaintiff originally claimed the fall occurred on the steps descending from the top deck, she subsequently indicated that she actually fell on landing after descending the stairs.

The defendant presented no expert testimony.The jury found for the defendant.
