The plaintiff alleged that the defendant company – a government contractor – wrongfully discriminated against his employment because of his race or national origin, which is Haitian. The defendant denied the allegations, and argued that the plaintiff was terminated for poor job performance.

The plaintiff was a senior network administrator and systems engineer for the defendant company. He claimed that the defendant discriminated against him by unfairly giving him poor job evaluations, criticizing his work, depriving him of raises, and finally terminating his employment in ________.

The defendant argued that the plaintiff’s poor performance evaluations and eventual termination were based on his failure to perform his job as the senior network administrator and systems engineer, and to proactively monitor the computer systems of which he was in charge. The defense pointed to a number of system failures – among other things – which occurred while the plaintiff was on duty.The jury found for the defendant.
