The parents of the male minor plaintiff brought this negligence suit against the defendant seeking compensation for the serious injuries their son sustained when he was struck by the defendant driver while the minor crossed a street on his bicycle. On April 4, ________, the male minor was riding his bicycle east across Durham Road in Middletown Township, Pennsylvania. At the same time, the defendant was traveling north on Durham Road when he struck the minor plaintiff. The plaintiffs allegations against the defendant were failing to apply the brakes in time to avoid an accident, failing to keep a proper lookout, failing to yield the right of way to the plaintiff, and operating his vehicle at an excessive rate of speed. As a result, the minor plaintiff suffered a lateral depressed tibial plateau fracture, proximal fibular buckle fracture, suprapatellar hemoarthosis, partial tear of the popliteus muscle, right orbital roof fracture, and optic neuropathy of right eye.
