$________ CONFIDENTIAL Negligent Supervision – Failure to provide adequate waterfront safety – Wrongful death of 17-year-old drowning victim

In this negligence matter, the plaintiff alleged that the defendant was careless in failing to provide proper supervision and lifeguard services at the beachfront where the 17-year-old decedent drowned. The defendant denied the allegations and disputed the nature and extent of the plaintiff’s injuries and damages.

The defendant provided lifeguard services and supervised lifeguards at the beach area where the 17-year-old male decedent was present for a retreat. On the day of the incident, the decedent experienced difficulty in the water, struggled for a period of time without any lifeguard assistance, and ultimately drowned. Although he was recovered from the water, he was unable to be resuscitated. The plaintiff brought suit, alleging that the defendant was negligent in failing to provide adequate lifeguard services at the waterfront, and in failing to properly supervise the lifeguards on duty to ensure that they were properly performing their tasks. The plaintiff contended that there was insufficient safety equipment present, and lifeguards were not properly trained.

The defendant denied the allegations. The defendant also disputed the nature and extent of the plaintiff’s injuries and damages.The parties agreed to mediate the plaintiff’s claim, and a confidential $________ settlement was reached as a result of that mediation.
