In this premises liability action, the plaintiff maintained that while he was lawfully on the defendant’s premises, the ceiling of the commercial property collapsed and struck the plaintiff. The defendant made a general denial of all allegations of negligence and injury.

On July 20, ________, the male plaintiff was a business invitee at the defendant’s commercial property on Upsal Street in Philadelphia, Pennsylvania. Suddenly, and without warning, part of the ceiling inside the building collapsed and fell onto the plaintiff, causing the plaintiff injury.

The allegations of negligence against the defendant contained in the plaintiff’s complaint were causing and permitting the ceiling to become and remain in a state of disrepair, failing to use reasonable and prudent care in maintaining the ceiling, failing to warn business invitees of the dangerous and defective condition, and failing to maintain the area in a reasonable and safe condition. As a result of the incident, the plaintiff suffered injuries to his head, neck, and back including post-concussion syndrome, and left leg radiculopathy. The defendant made a general denial of all liability and injury.The jury found no negligence on the part of the defendant.
