Medical Malpractice – Alleged negligent failure of defendant urologist to conduct additional surgery or consult with interventional radiologist after bleed discovered several days following kidney stone procedure – Wrongful death

This case involved a decedent in his mid 70s who had undergone a lithotripsy procedure that utilized ultrasonic waves to break up kidney stones. There was no claim that the procedure, conducted by another physician, was negligently performed, or that the decedent was discharged home prematurely.

The plaintiff contended that when the decedent returned to the hospital two days after the procedure complaining of severe abdominal pain, and a CT reflected abdominal bleeding, the defendant urologist should have either consulted with an interventional radiologist, or performed surgery to identify the source and stop the bleeding. The decedent died approximately 4-5 days later.

The defendant maintained that the decedent died despite appropriate care, and supported that surgery would have been very dangerous. The defendant also denied that the use of an interventional radiologist was required, or that such consultation would have led to a timely identification of the source of the bleeding.The jury found for the defendant.
