In this motor vehicle negligence matter, the plaintiff alleged he sustained back injuries when a ladder attached to his pickup truck was struck by the defendant’s garbage truck. The defendant denied the incident and maintained that the plaintiff’s vehicle rolled backward and the ladder struck the defendant’s truck. The defendant also disputed causation and the nature and extent of the plaintiff’s injuries and damages.

On November 17, ________, the male plaintiff was operating his pickup truck and had a ladder strapped to the truck. The plaintiff alleged that he brought his vehicle to a stop for a red light when the ladder was struck by the defendant’s garbage truck. As a result of the force of the impact, the plaintiff alleged he sustained injuries to his back. The plaintiff brought suit against the defendant alleging negligence in the operation of his vehicle.

The defendant disputed the plaintiff’s version of the collision. The defendant argued that his vehicle was stopped when the defendant’s vehicle rolled backward and the plaintiff’s ladder came into contract with the defendant’s truck. The defendant also maintained that the impact between the ladder and the truck was minimal and disputed causation, as well as the nature and extent of the plaintiff’s injuries and damages. The defendant argued that the plaintiff had preexisting back injuries which were the cause of his alleged injuries.

The matter proceeded to trial.At the conclusion of the trial, the jury deliberated and returned its verdict in favor of the defendant and against the plaintiff. No damages were awarded.
