In this negligence matter, the plaintiff family alleged that the defendant town and its high school were negligent in failing to properly supervise students in the school’s swimming pool during physical education class which resulted in the drowning death of the plaintiff’s son. The defendant denied liability and disputed the nature and extent of the plaintiff’s injuries and damages.

The 14-year-old male decedent was a freshman at the defendant town’s high school. During physical education class on November 21, ________, the student was not properly supervised and drowned in the deep end of the pool. The plaintiff alleged that the school failed to properly supervise the student, who had been evaluated and advised to stay in the shallow end of the pool due to his lack of swimming skills. The plaintiff alleged that the student was under water for approximately 17 minutes before he was noticed and pulled from the water. Attempts to revive the child were unsuccessful.

The family brought a claim of its intention to sue the town for negligent supervision, and failure to timely rescue and provide medical care to the deceased student. The defendant agreed to resolve the claim prior to the institution of suit. The parties agreed to a settlement of $________ which was approved by the probate court.
