This was a Lemon Law action brought by the plaintiff against the defendant American Honda Motor Company. The plaintiff alleged that a ________ Honda Accord manufactured by the defendant was defective and the defect could not be repaired after reasonable attempts. The defendant denied that the vehicle was defective.

The plaintiff alleged that a clicking noise in the braking system of his Honda Accord was so annoying that the resale value had been substantially diminished. The defendant maintained that the click, complained of by the plaintiff, was a product characteristic of the braking system and did not substantially impair the use, value or safety of the vehicle.The case was heard before the Florida New Motor Vehicle Arbitration Board. The three-member panel unanimously found the vehicle was not a lemon.
