$________ – EMPLOYER’S LIABILITY – CLASS ACTION – NATIONAL FOOTBALL LEAGUE PAYS OUT COMPENSATION, MEDICAL EXAMS AND RESEARCH TO FORMER PLAYERS SUFFERING CONCUSSION-RELATED BRAIN INJURIES – NO LIABILITY ADMITTED.

U.S.D.C. - Eastern District of Pennsylvania

In this historic class action suit, former United States District Judge Layn Phillips, the court-appointed mediator in the consolidated concussion-related lawsuits brought by more than ________ retired football players against the National Football League and others, announced on August 29, ________ that the parties had reached an agreement that would provide medical and other benefits, as well as compensation, to qualifying injured players or their families. As part of the agreement, the NFL did not admit that the plaintiffs’ injuries were caused by football.

Nearly ________ former football players sued the NFL for injuries they contend they sustained while playing football. The plaintiffs included at least ten members of the Pro Football Hall of Fame, including former Dallas Cowboys running back Tony Dorsett. They also included Super Bowl-winning quarterback Jim McMahon and the family of Pro Bowl linebacker Junior Seau, who committed suicide last year. The players maintained that the league knowingly concealed the dangers of brain injury from concussions while profiting from the sport’s violence, according to court papers.

The lawsuits accused the league of hiding known risks of concussions for decades and encouraged players to return to playing football without having recovered from symptoms of head trauma. In recent years several former NFL players, including Junior Seau and Ray Easterling, were diagnosed, following their deaths, with chronic traumatic encephalopathy bringing more media attention and focus to the issue of long term psychological and physical damage to players who suffered multiple concussions during their football careers. The NFL denied any wrongdoing and insisted that player safety has always been a top priority. However, the settlement likely means that the NFL won’t have to disclose internal files about what it knew, when, about concussion-linked brain problems.According to the settlement, $________ million dollars will be allocated to compensate former players and their families who have suffered cognitive injury. The rest of the award will be used for baseline medical exams and research and education.
