The decedent was a resident of Brazil who was landing in his helicopter at his Sao Paulo, Brazil residence when the helicopter crashed. The plaintiff alleged that the crash resulted from a defective engine part designed and manufactured by the defendant helicopter manufacturer. The company which maintained the helicopter was also named as a defendant, but went out of business and was not represented.

The decedent was returning to his Brazilian home on January 5, ________. Also on board was the pilot, co-pilot, the decedent’s wife, the decedent’s minor daughter and the daughter’s friend. Evidence showed that the aircraft was hovering over the landing pad at a height of approximately 60 feet when engine problems were encountered.

The plaintiff claimed that the engine suddenly failed and caused the helicopter to crash to the ground and burst into flames. The plaintiff’s liability expert opined that a tooth-geared engine part, known as a “corncob”, was improperly designed and misaligned in the engine. As a result, the plaintiff claimed that the teeth of the gear in question wore down and then broke off and caused the sudden engine failure.

The decedent was self-employed as a boat manufacturer. The decedent’s wife sustained multiple fractures of her vertebra and ribs, as well as third-degree burns as a result of the crash. The decedent’s daughter was diagnosed with vertebra fractures and lung contusions and her friend sustained a calcaneus fracture of the heel. The plaintiff pilot and co-pilot suffered injuries to the chest and ribs with vertebra fractures.The case was settled for a total of $________ for all plaintiffs.
