In this matter, a New York man spent ten years in prison for a crime he did not commit. The state agreed to settlement in the Court of Claims.

For ten years of his life, the plaintiff Michael C. was incarcerated in a New York prison for the March 30, ________ murder of John B. at a Bronx Domino’s Pizzeria. The plaintiff was found guilty of Second Degree and Criminal Possession of a Weapon in the Second Degree, in spite of testimony in an unrelated case by a federal witness which vindicated him. The plaintiff was released in April ________, with all charges later dismissed by the district attorney. The plaintiff, 25 at the time of his conviction, was a member of Local One International Union of Elevator Constructors, and had recently completed his apprenticeship in his father’s trade. He had no prior criminal record.

The plaintiff filed suit in the New York Court of Claims for a violation of 8-b of the Court of Claims Act (Unjust Conviction and Imprisonment Act of ________). The plaintiff sought damages from the State of New York for wrongful imprisonment, citing loss of earnings for the disruption of his career as an elevator constructor, as well as the financial burden of his legal defense on his family.The defendant State agreed to settle the matter for $2 million in damages.
