The plaintiff patron of the defendant bowling lanes, approximately 50, contended that when she requested a key from the counter person, he negligently slammed the keys down against the counter in jest, resulting in a small piece of metal being propelled into her eye. The defendant denied that he slammed the keys down against the counter or that any action on his part contributed to the incident.

There was no independent eyewitness testimony. The plaintiff established that the investigating police officer observed a small piece of metal missing from the key. The plaintiff contended despite some five surgical interventions, she will permanently suffer a partial vision loss.

The jury found that the defendant was not negligent.
