Premises liability - Alleged negligent maintenance of bowling alley - Claimed slip and fall as a result of lane polish - Cervical disc herniation with surgery.

The plaintiff was a patron of the defendant’s bowling alley when she claimed she slipped and fell as a result of the defendant’s negligent application of polish to the bowling lane. The defendant argued that the bowling lane was not dangerous and that it was required to be polished in order for the bowling balls to roll properly.

The plaintiff was a female in her 50s at the time of the fall. She testified that she went slightly over the line into the bowling lane. The plaintiff claimed that her shoes picked up the polish from the bowling lane and caused her to fall when she subsequently tried to roll another bowling ball.

The plaintiff argued that it was foreseeable that armature bowlers might cross over the line and enter the bowling lane. The plaintiff contended that the defendant should not have extended the polish all the way up to the bowling line. The plaintiff sustained a cervical disc herniation which required surgery as a result of the fall. The defendant argued that it properly maintained the bowling lanes and was not negligent.

The jury found that the defendant was not negligent.
